What are my rights when pruning a neighbour’s tree that overhangs my property?

In both Halton Hills and the Peel Region (including Mississauga, Brampton, and Caledon), you are legally allowed to prune branches from a neighbour’s tree only if they cross over your property line.  However, there are important conditions to keep in mind:

  • You may only prune up to the property line.  You cannot enter your neighbour’s property or damage the tree’s health.
  • You must not cause harm to the tree (e.g. cutting too much or damaging the trunk, root system, or overall stability).
  • You are responsible for any damage caused to the tree during pruning.
  • It is recommended to speak with your neighbour first.  While not legally required, good communication can help avoid disputes.
  • If the tree is protected under a municipal bylaw (e.g. heritage or significant trees), you may need a permit, even for branches on your side.  Always check your local municipality’s tree bylaws before proceeding.
